With the stroke of a pen, Governor Jack Markell effectively was able to eliminate three out of
seven of Delaware’s minor parties, by amending the voter registration statistics cited.  The
arbitrary restriction of voter choices in the 2010 elections disregards the public good in the
conflicts of rival parties. Damaging the advancement of liberty entitled to be exercised by
voters, not according to the rules of justice and the rights of the minor party members, but
by the superior forces of an interested and overbearing majority.  Knowingly causing harm
to democracy, in this age of special interest control upon the people of Delaware’s
government.
That removal of the minor parties is challenged in this litigation as violating voters'
constitutional right of association. The right of association guarantees individuals the right to
join with like minded individuals to accomplish a shared political objective that is protected
by the First Amendment

"We Implored the Commissioner of Elections office not to implement this new law until
after the General elections Her response was:  All minor parties have until late August
to increase the number of voters registered in their respective parties.  No party was
elimated, however, ballot status will be determined by the number of registered voters
all parties have in August."                                - Elaine Manlove

We the members of the constitution party will continue working to meet these overbearing
requirements that have been thrust upon us in the middle of an election year moving the
guide posts of election rules.Which are nothing less than arrogant violations of all
Delawareans rights and freedoms. protected in both the State Constitution and US
Constituion

However!!!

In August, If we are unable to muster the required members to the party, and denied ballot
access. The States Governor, the Commissioner of Elections and all other responsible State
Defendants will be forcing each and everyone of Delaware's Taxpayers to pay millions of
dollars in legal fees, defending the state on the charges of infringing the rights of the
minority citizens of Delaware!
